The Swiss Code of Obligations is a central code of Swiss civil law that regulates the legal relationships between private individuals. It includes five books that cover various aspects of contract law, law of obligations and property law, including the formation, content and termination of contracts, as well as liability for breach of contract and tort. The Code of Obligations is an important code of law for business and everyday life in Switzerland, as it forms the basis for many legal relationships and contracts and has been in force since 1912, whereby it is regularly adapted to social and economic developments.

Art. 40e Form and time limit (1)

1 Revocation need not be in any particular form. The onus is on the customer to prove that he has revoked the contract within the time limit. (2)

2 The prescriptive period for revocation is 14 days and commences as soon as the customer: (2)

  • a. has proposed or accepted the contract; and
  • b. has become aware of the information stipulated in Art. 40d.
  • 3 The onus is on the supplier to prove when the customer received the information stipulated in Art. 40d.

    4 The time limit is observed if, on the last day of the prescriptive period, the customer informs the supplier of revocation or posts his written notice of revocation. (2)
