Art. 245 Summons to a hearing and statement of defence
1 If no grounds are stated for the action, the court shall serve the defendant with the statement of claim and summon the parties to a hearing. If a party fails to attend the hearing, the court shall immediately issue one further summons to the hearing and inform the parties of the consequences of any further default on their part. The hearing shall take place within 30 days of the first hearing. (1)
2 If the grounds for the action are stated, the court shall first set a deadline for the defendant to file a written response to the claim. If the court summons the parties to the hearing, Article 234 applies mutatis mutandis in the event of default. (2)
