Art. 21 Precedence

1 Foreign nationals may be permitted to work only if it is proven that no suitable domestic employees or citizens of states with which an agreement on the free movement of workers has been concluded can be found for the job.

2 Domestic employees include:

  • a. Swiss nationals;
  • b. persons with a settlement permit;
  • c. persons with a residence permit authorising them to work;
  • d. (1) temporarily admitted persons;
  • e. (1) persons who have been granted temporary protection and have a permit entitling them to take up employment.
  • 3 Foreign nationals with a Swiss university degree may be admitted in derogation from paragraph 1 if their work is of high academic or economic interest. They shall be admitted for a period of six months following completion of their education or training in Switzerland in order to find suitable work. (3) (4)
